G2Y Houseboat Hire Subscription Terms and Conditions

1. All references in the 'Subscription Terms and Conditions' to 'we', 'our' or 'us' refers to G2Y Houseboat Hire, 60 Clarence Street, Brushgrove, NSW 2460.

2. To register as a 'G2Y Houseboat Hire Subscriber' (Subscriber), a person must use a compatible internet browser to visit our subscription webpage www.g2yhouseboats.com/promotions and follow the directions published there.

3. By submitting your details on our subscription page you confirm your agreement to becoming a Subscriber and your acceptance of these terms and conditions.  You may unsubscribe at any time by contacting us or by following the link provided in promotional emails.

4. The personal information we collect from Subscribers is first name, last name and email address.  Subscribers must have a current, valid email address.  Subscribers may update their email address at any time by contacting us.

5. Subscribers' personal information will be collected by us, or on our behalf, to enable us to administer, conduct and publicise our promotions.  We do not sell or share email addresses to any third party as part of our Subscription program, however, they may be made available to some third parties for the purpose of Promotions as described in the Promotion Terms and Conditions. Subscribers acknowledge that their personal information held by us may be hosted on servers or by organisations outside of Australia and they provide their consent for this to occur by becoming a Subscriber.

6. Subscribers can find out what personal information we hold about them, or update their personal information, at any time by contacting us.

 

G2Y Houseboat Hire 'Win A Holiday Weekend' Promotion Terms and Conditions

 

1. Introduction

1. The 'Win A Holiday Weekend' Promotion (the 'Promotion') is authorised by the NSW Office of Liquor, Gaming and Racing ('OLGR') NSW Permit Number: LTPS/15/05850.

2. The Promotion is conducted by G2Y Houseboats Administration Trust ABN  43 858 528 404 of 60 Clarence Street Brushgrove NSW 2460 (the 'Promoter').

3. By participating in the Promotion, individuals accept these terms and conditions (the 'Conditions').  Information on how to participate and prizes form part of the Conditions.

4. All references to dates and times in the Conditions are references to dates and times in Sydney, which may be Australian Eastern Standard Time (AEST) or Australian Eastern Daylight Time (AEDT), depending on the date.

5. The word 'including' means 'including without limitation', and 'includes', 'included' and 'in particular' are also to be understood as being without limitation.

6. All references to 'dollars' or '$' are references to Australian dollars.

 

2. Eligibility

1. Participation in the Promotion is only open to persons who are 'eligible persons' and who become Subscribers (as described in the G2Y Houseboat Hire Subscription Terms and Conditions) during the Promotion period.

2. An 'Eligible Person' is an individual who: (i) is a resident of Australia aged 21 years, or older; and (ii) is not an employee of the Promoter, or any of its related entities or any of their agencies, associated with the Promotion.

3. Subscribers' personal information will be collected by or on behalf of the Promoter to enable it to administer and conduct the Promotion to publicise winners. The personal information of Subscribers may be provided to others assisting in the conduct of the Promotion, including the Promotion administrator, suppliers and deliverers, and to authorities that regulate the Promotion. Consumers may contact the Promoter via the Promoter's website to request access to, or corrections of, any of their collected personal information that is held by the Promoter.

4. If a Subscriber does not provide accurate personal information, the Promoter may determine that they are not eligible to win a prize. You may view our Privacy Policy here.

 

3. Prizes

1. There are two (2) prizes available in the Promotion.  Each prize consists of three (3) nights hire of the houseboat, Idyll Daze, (the 'Prize Vessel') during off-peak or normal season (maximum value $1,175).

2. This promotion has been extended and there will be an additional draw on Thursday 1 December 2016.

3. All current Eligible Persons will be entered in the additional draw.

4. The first valid entry drawn in each draw will be the winner of the prize.

5. The prize is not transferrable or redeemable.  However, the prize may, at the Promoter's sole discretion, be used as a credit for an 'Alternate Prize' as described in this clause.  An Alternate Prize is a booking on a different houseboat and/or for a different number of nights than the advertised Prize description.  An Alternate Prize is subject to availability of the different vessel and/or nights.  If the Alternate Prize booking fee value is less than the Prize value ($1,175), the difference in value will be forfeit.  If the Alternate Prize hire fee value is more than the Prize value ($1,175), the Prize value ($1,175) may be used as a credit toward the applicable hire fee. Neither the Prize nor the Alternate Prize can be used during peak season, including during NSW school or public holidays.

6. The prize is valid for twelve (12) months from the draw date.

7. The winner may claim the prize by contacting the Promoter and booking the Prize Vessel (or alternate vessel as described above) in accordance with the Promoter's standard terms and conditions of houseboat hire as published on the Promoter's website.

8. The winners will be notified in writing by email within two (2) days of the respective draw.  The winners' names will be published on the Promoter's website and social media pages.

 

4. Unclaimed Prizes

1. In the event that a Prize remains unclaimed three months after each draw date (1 March 2016 and 5 July 2016, respectively) or unused by the end of the 12 month period for which the prize is valid (1 December 2016 and 5 April 2017, respectively) all of the original Eligible Persons will be entered into an unclaimed prize draw.

2. The unclaimed prize draws, if necessary, will take place at the Promoter's address within seven (7) days of the respective dates in clause 4.1, subject to any written directions from OLGR.

 

5. General Conditions

1. If, for any reason, the conduct or operation of the Promotion or Subscription system is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right, subject to any written directions of OLGR, to cancel, terminate, modify or suspend or recommence the Promotion.

2. If a Subscriber tampers with, or subverts, the processes relating to participation in the Promotion or Subscription system, or may benefit from such tampering or subversion by any other person, the Promoter reserves the right in its sole discretion to disqualify that Subscriber from the Promotion. The Promoter reserves the right to verify the details of the Subscriber, and request identification to establish their identity.

3. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failures, theft or destruction or unauthorized access to, or alteration or non-receipt of Subscribers' communications. The Promoter is not responsible for any problems or technical malfunctions (such as problems with telephone networks or lines, computer systems or software or internet service providers) or any failure of any internet communication or telephone communication to be received by the Promoter (whether as a result of technical problems or traffic congestion on any carrier network, on the internet or at any website). To the full extent permitted by law, the Promoter is not liable for any injury or damage to any Subscriber's (or any other person's) computer or resulting from or otherwise relating to participation in the Promotion(including by downloading materials relating to the Promotion).

4. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.

5. All of the Promoter's decisions are final and no correspondence will be entered into.

6. Subscribers who win a prize consent to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this or any future Promotion.

 

6. Limited liability

1. The Promoter accepts no responsibility for any tax liability incurred as a result of a Subscriber winning a prize. Subscribers should obtain independent tax and financial advice.

2. No responsibility is accepted for late, lost, or misdirected submission of winner notification messages.  The Promoter is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilised in the Promotion which may occur in the course of the administration of the Promotion.

3. Any costs associated with accessing the Promoter’s Website are the responsibility of the person seeking access and are dependent on the internet service provider used.

4. To the full extent permitted by law, the Promoter, its personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any person in connection with the Promotion, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from negligence; and (iii) any liability for personal injury or death. Nothing in these Conditions is intended to exclude, restrict or modify a person's rights under the Competition and Consumer Act 2010
